These Terms and Conditions (“Terms”) apply to all purchases made through this website (“Site”).
The Site is operated by Benjamin Mowll, a UK sole trader trading as Benjamin Mowll (“we”, “us”, “our”).
By placing an order through this Site, you agree to be bound by these Terms.
Contract Formation
No contract exists between you and us until we have accepted your order and received payment in full.
Once payment has been received, you will receive an order confirmation by email.
All artwork is sold subject to availability.
Artwork Descriptions & Images
All artworks sold on this Site are original works by the artist unless otherwise stated.
All original artworks are supplied framed unless stated otherwise.
The dimensions shown on the Site refer to the artwork (canvas or board) only and do not include the frame.
All sizes are approximate rather than precise. Please bear this in mind if you are purchasing an artwork to fit a specific space.
Images are provided as accurately as possible, but colours may vary slightly due to screen settings, photography, and lighting conditions. Minor variations are considered normal and acceptable.
If you require exact dimensions including framing, please contact us before purchase at mowllstudio@gmail.com.
Prices & Payment
All prices are shown in GBP (£).
We are not VAT registered, therefore VAT is not charged.
Prices are subject to change, but the price displayed at the time of ordering is the price you will pay.
Payment is required in full at the time of purchase.
Payment may be made by credit or debit card via the Site. Payment by cheque from a UK clearing bank may be accepted by prior arrangement — please contact us before ordering.
Pricing Errors
If a pricing error occurs, we reserve the right to cancel the order and issue a full refund, or to contact you with the correct price and give you the option to proceed or cancel.
Delivery
We aim to dispatch orders promptly and, in any event, within 30 days of order acceptance.
Delivery to the UK mainland is free of charge.
For delivery outside the UK mainland, please contact us at mowllstudio@gmail.com before purchase so we can provide a delivery quote.
We reserve the right to cancel and refund any order where delivery outside the UK mainland has not been agreed in advance.
Delivery times may vary due to holidays, courier delays, or circumstances beyond our reasonable control.
Risk & Ownership
Risk in the goods remains with us until they are delivered to you.
Ownership of the artwork passes to you once full payment has been received.
International Orders
Orders shipped outside the UK may be subject to import duties, taxes, or customs charges imposed by the destination country. These charges are the responsibility of the buyer and are not included in the purchase price.
Availability
All goods are subject to availability.
If we are unable to supply an item, we will notify you as soon as possible and offer either a substitute of equivalent quality and price or a full refund.
Right to Cancel (Distance Selling)
You have the legal right to cancel your order within 14 calendar days of receiving the goods, without giving any reason.
How to Cancel
To cancel your order, please email mowllstudio@gmail.com within 14 days of delivery.
Returns
You must return the goods within 14 days of notifying cancellation.
You are responsible for the cost of return postage.
Returned items must be packaged securely and returned in the condition received.
Refunds
We will refund the full purchase price (including standard delivery costs, where applicable) within 14 days of receiving the returned goods or proof that they have been sent back.
We may deduct an amount from the refund if the artwork has been handled beyond what is necessary to inspect it, resulting in damage or deterioration.
Your statutory consumer rights are not affected.
Faulty or Damaged Items
If your artwork arrives damaged or faulty, please contact us as soon as possible with photographs and details of the issue.
Nothing in these Terms limits your rights under the Consumer Rights Act 2015.
Artwork Care & Hanging Advice
Original artworks are delicate and should be handled with care.
We recommend avoiding direct sunlight, high humidity, excessive heat, or damp conditions, as these may cause damage over time.
Framed artworks should be hung using appropriate fixings suitable for the weight of the piece and the type of wall.
We cannot accept responsibility for damage caused by improper handling, hanging, environmental conditions, or failure to follow reasonable care advice.
Commissioned Artwork
Commissioned artworks are created specifically to your requirements.
Due to their personalised nature, commissioned artworks are non-refundable once work has begun, unless faulty or not as described.
Any agreed specification, price, and timescale will be confirmed in writing before work begins.
Minor variations in style, colour, or composition are part of the creative process and are not considered faults.
This does not affect your statutory rights.
Intellectual Property
Copyright and all intellectual property rights in the artwork remain with the artist.
Purchase of an artwork does not grant the right to reproduce, copy, or commercially exploit the image without written permission.
Marketing Communications
If you purchase from us, we may occasionally send you emails about similar artwork, exhibitions, or studio updates. You can opt out at any time by clicking the unsubscribe link in our emails or by contacting us directly.
Security
We take reasonable steps to protect your payment and personal information using secure third-party payment providers. While we take appropriate precautions, we cannot guarantee absolute security of data transmitted online.
Liability
We do not exclude or limit liability for death or personal injury caused by our negligence, fraud, or any matter where liability cannot legally be excluded.
Subject to this, our liability to you shall not exceed the price paid for the artwork in question.
We are not liable for indirect or consequential losses.
Force Majeure
We are not liable for any failure or delay caused by events beyond our reasonable control, including acts of God, transport disruption, or courier delays.
Governing Law
These Terms are governed by English law, and any disputes shall be subject to the exclusive jurisdiction of the English courts.
